1. Who we are

Move Snacks is provided by Spidersoft Pty Ltd, an Australian company. Our website is movesnacks.app.

2. Using Move Snacks

Move Snacks helps you plan and track short movement breaks, sometimes called exercise snacks. It is designed to support consistency with simple movement routines.

You must use Move Snacks only for lawful purposes and in accordance with these terms.

3. Health and safety

Use your own judgment before starting any movement or exercise. Stop exercising if you feel pain, dizziness, shortness of breath, discomfort, or anything that does not feel right.

You should seek advice from a qualified health professional before starting or changing exercise if you have a medical condition, injury, are pregnant, have concerns about exercise, or are unsure whether an activity is suitable for you.

4. Not medical advice

Move Snacks does not provide medical, physiotherapy, exercise physiology, healthcare, diagnosis, treatment, or rehabilitation advice.

Any movement suggestions, reminders, tracking, or app content are general in nature and may not be suitable for your individual health, fitness, ability, or circumstances.

5. Your responsibility when exercising

You are responsible for exercising safely and choosing movements that are appropriate for your own ability, environment, and circumstances.

Before exercising, make sure you have enough clear space, safe surroundings, suitable footwear or equipment where needed, and no hazards that could cause injury.

6. Accounts and local data

Move Snacks does not require a user account for v1. App data may be stored locally on your device, including activity history, preferences, favourites, reminder settings, streaks, and app settings.

Deleting the app may delete locally stored app data from your device, unless iOS or app settings provide another option.

7. Purchases and subscriptions

If Move Snacks offers paid features, subscriptions, or in-app purchases, those transactions are processed through Apple's App Store.

Subscription billing, cancellation, renewal, refunds, and payment management are handled through your Apple ID and App Store account, subject to Apple's terms. Move Snacks does not receive your full payment card details.

8. App Store terms

Your use of the Move Snacks iPhone app may also be subject to Apple's App Store terms, policies, and any applicable Apple end user licence agreement.

If there is a conflict between these terms and Apple's terms for App Store billing, downloads, refunds, or Apple platform rules, Apple's terms may control those Apple-managed matters.

9. Acceptable use

You must not misuse Move Snacks, attempt to interfere with its operation, access it in an unauthorised way, copy or reverse engineer it except where permitted by law, or use it for unlawful, harmful, or abusive purposes.

You must not use Move Snacks in a way that infringes another person's rights or interferes with another person's use of the app or website.

10. Intellectual property

Spidersoft Pty Ltd owns or licenses Move Snacks, including the app, website, content, design, branding, images, text, software, and related materials.

You may use Move Snacks for your personal use in accordance with these terms, but you must not copy, distribute, modify, sell, or commercially exploit our materials unless we give you permission or the law allows it.

11. App availability and changes

Move Snacks may change over time. We may add, change, limit, suspend, or remove features, content, or functionality.

The app, website, and related services may not always be available, error-free, secure, or uninterrupted.

12. Disclaimers

To the extent permitted by law, Move Snacks is provided on an as-is and as-available basis. We do not promise that the app will meet your particular needs, produce any particular health or fitness result, or be suitable for every user.

You are responsible for deciding whether Move Snacks and any movement activity is appropriate for you.

13. Limitation of liability

To the extent permitted by law, Spidersoft Pty Ltd is not liable for loss, damage, injury, or expense arising from your use of, inability to use, or reliance on Move Snacks, except where liability cannot be excluded under applicable law.

Nothing in these terms excludes, restricts, or modifies any rights or remedies that cannot be excluded, restricted, or modified under Australian Consumer Law or other applicable law.

14. Australian Consumer Law

Nothing in these terms limits any non-excludable consumer guarantees, rights, or remedies you may have under the Australian Consumer Law or other applicable laws.

Where we are allowed to limit a remedy under applicable law, our liability is limited to the maximum extent permitted by that law.

15. Privacy

Our Privacy Policy explains how Move Snacks handles information.

16. Changes to these terms

We may update these terms as Move Snacks changes. If we make material changes, we will update the effective date and provide notice where appropriate.

If you continue using Move Snacks after the updated terms take effect, you agree to the updated terms.

17. Governing law

These terms are governed by the laws of Victoria, Australia. You and Spidersoft Pty Ltd submit to the courts with jurisdiction in Victoria, Australia, subject to any rights you have under applicable consumer laws.
